The court ordered the authorities to exhume the body of BNP leader Haris Chowdhury from his grave in her petition. On Tuesday, October 8, the Dhaka District Magistrate’s Office’s judicial branch issued a direction in this regard.

Executive Magistrate SM Rasel Islam Nur was asked to be present when the body was exhumed from Jamia Khatamun graveyard in Khatamun Nabin under Savar model police station.

At the same time, magisterial duties, including controlling the law and order situation, were also talked about.

In the writ petition No- 10787/24 of the High Court Division, the court ordered to collect DNA samples by exhuming the body of Haris Chowdhury. His daughter Samira Tanzim filed the writ petition with the High Court Division of the Supreme Court. His father, Haris Chowdhury, was buried at the Jamia Khatamun graveyard in Khatamun Nabin under the name of Mahmudur Rahman. Haris also demanded that Chowdhury’s remains be exhumed from the grave, DNA tests be conducted to prove his identity, a positive identity result, a death certificate be obtained, his name be removed from the Interpol red notice and he be buried with due respect as a freedom fighter in his home district.

In this situation, according to the order of the writ petition of the High Court Division of the Supreme Court, Executive Magistrate SM Rasel Islam Nur has been assigned to perform magisterial duties including controlling the law and order situation during the exhumation of Haris Chowdhury’s body as per the provisions of Section 176 (2) of the Code of Criminal Procedure.

BNP leader Harris Chowdhury’s body was exhumed from the tomb earlier on September 5 after the High Court ordered a DNA test. The order was issued by the High Court bench consisting of Justices AKM Asaduzzaman and Md. Mozibur Rahman Miah. After considering a writ suit submitted by Samira Tanzim Chowdhury, the daughter of Harris Chowdhury, the court issued the ruling. The writ petition was represented by Barrister Mahdin Chowdhury.

Khaleda Zia, the chairperson of the BNP, had Haris Chowdhury as his special assistant and political secretary.
