Supervisor living inhumanely for 15 years rubber plantation in Kulaura

Shamim Ahmad, taping supervisor of the Bhatera rubber plantation in Kulaura upazila of Moulvibazar, lost his job in 2009 after being a victim of the conspiracy of the labour league of the plantation. The matter was brought to the Labour Court.

The Labour Appellate Tribunal has ordered him to be reinstated in his position and paid salary and allowances, but the judgement is not being implemented. As a result, he has been living a non-human life for 15 years.
It is known that Shamim Ahmed, son of Abul Kashem of Islamnagar village in Bhatera union of the upazila, joined the service in Bhatera rubber garden in 1983. I was promoted to tapping supervisor in 2005.
In 2002, he formed the Nationalist Labour Party in Rubber Bagan and was elected as the general secretary of the party. Besides, he was elected two-time general secretary and two-time president of the Rubber Plantation Workers Trade Union. In 2005, he was elected General Secretary of the Trade Union Sylhet Zone Federation.

After the resignation of the Awami League government in 2008, the Sramik League filed a complaint against him on September 22, 2009. In the wake of that complaint, they conducted a unilateral investigation and suspended him on August 22, 2009, with the testimony of their party leaders. He was reinstated by the authorities after pleading his defence.
The Sramik League leaders were enraged by this. Party leaders, tree thieves, and outside terrorists united and attacked Shamim Ahmed in the office area. Not only that, it also prevents him from performing his duties at the workplace. In this situation, on December 22, 2009, the Sramik League leaders filed another complaint. If the investigation committee formed on that complaint was influenced by party leaders, Shamim Ahmed objected to the investigation committee and applied for re-investigation.
Disappointed by the harassment in the name of one complaint and investigation, Shamim Ahmed filed a case (No. 28/10) in Moulvibazar Judge Court to stay in the job. The court issued a show cause notice to the general manager, assistant manager, and engineer (mechanical). Enraged by this case, he suspended Shamim Ahmed on May 17, 2010. In view of this, he was permanently dismissed from the job on July 15 without any investigation or any opportunity to defend himself.
Shamim Ahmed filed a case (No. 9/10) in the Chittagong Labour Court against this order of permanent dismissal from office. After nine years of litigation, on September 13, 2018, the court dismissed the case without any reason.
Shamim Ahmed did not stop at this. He filed an appeal case (No. 225/18) in the Labour Appellate Tribunal. On April 6, 2023, the appeal was allowed. The appellate court ordered him to join the service and pay the arrears on his salary. In view of the court’s verdict, Shamim Ahmed submitted his joining letter to Bhatera Rubber Plantation on April 24. But when Bagan authorities filed a writ petition (No. 15640/23) in the High Court against the said ruling, the court rejected the writ petition on January 22, 2024, this year. On January 27, he submitted the rejoining letter with the court order. But even after six months passed, the authorities did not take any initiative to implement the judgement in court. Shamim Ahmed made an application to the chairman of the corporation on June 24, and his lawyer issued a legal notice on July 15.
Victim Shamim Ahmed said that he lost his job due to a conspiracy and has been living an inhumane life with his family for the last 15 years. In the current situation of the country, he wants to implement the court verdict and get his job back.
